Contest Terms and Conditions

General Premise

1. The Contest is organized by FantaStory.com.
2. NO PURCHASE NECESSARY.  BY SUBMITTING AN ENTRY IN THE CONTEST, THE ENTRANT AGREES TO BE BOUND BY THESE TERMS AND CONDITIONS AND THE DECISIONS OF FantaStory.com AND THE CONTEST JUDGES. 
3. Prizes for Winner(s) of the Contest may or may not include cash prizes.
4. The Contests may be weekly, monthly or anually. Check the details of each individual contest in order to determine it's periodicity.
5. The Contest is intended to promote the awareness of the FantaStory.com domain and to foster interest in participating in adding stories, voting on stories, and sharing in forum discussions.

Participation

1. Participation in the Contest is open to anyone 18 years of age or over ("Participant") with the exception of the persons referred to below.
2. Persons excluded from participation are: (a) employees and directors of FantaStory.com; and (b) Employees and anyone who is involved directly with the operations and management of FantaStory.com; and (c) persons who are immediate family members (i.e., parents, children, siblings, spouses) of, or reside in the same household (whether related or not) as, any person in either of the preceding categories.
3. Participation in the Contest is free.  The costs for using the Internet, an Internet connection or other costs for the submission of the Entry are borne by the Participant.
4. Participation in the Contest is not subject to any obligation to purchase.
5. By participating in the Contest with the submission of an Entry, the Participant declares that he/she agrees to and shall comply with these Terms and Conditions.
6. FantaStory.com reserves the right in its sole discretion to disqualify, at any point in time, any submission that does not comply with the requirements set forth in these Terms and Conditions, or for any reason, without notification.
7. Any direct or indirect form of gaming, collusion, misrepresentations or otherwise deceptive or abusive behavior shall be deemed a violation of these Contest Terms and Conditions.  FantaStory.com reserves the right, at its sole discretion, to disqualify and cancel an entry from any individual it finds to be caught tampering or suspected of tampering with the operation of the Contest, acting in violation of these Terms and Conditions or acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other Participants.
8. CAUTION: ANY ATTEMPT BY AN INDIVIDUAL DELIBERATELY TO DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, FantaStory.com RESERVES THE RIGHT TO SEEK COMPENSATORY, PUNITIVE AND OTHER DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.  In the event of such an occurrence, any damage to the website(s) or the Contest will be the responsibility of the authorized account holder of the screen name or e-mail address shown in the entry. "Authorized account holder" is defined as the person who is assigned to a screen name or avatar by the website through which the entry was submitted, or the person who is assigned to an e-mail address by an Internet access provider/online service provider/other organization that is responsible for assigning e-mail addresses for the domain associated with the registered e-mail address.
9. If an Entry is cancelled by FantaStory.com, the relevant participation in the Contest shall be terminated, and all associated rights shall lapse.

Submission Rules

1. Participants must submit an Entry utilizing the online form under the Contribution link.
2. Each Participant must submit the following in an Entry: (a) all the FantaStory.com Category Name for which the Participant believes the story contains ; (b) the name of the story; (c) the story itself;
3. FantaStory.com intends to maintain the website and to make it accessible everyday to anyone free of charge during the course of the Contest.  FantaStory.com does not guarantee that the Contest website will be accessible at all times.  Internet traffic conditions or availability or server capacity may limit or cause the accessibility to deteriorate to differing degrees.
4. By submitting an Entry, the Participant represents and warrants that he/she has all necessary rights to make the submission.
5. Each Participant may submit as may entries as the Participant wishes
6. Entry forms received with missing or incorrect information will be considered defective and disqualified.  A Participant with an invalid or falsified email address shall be disqualified.
7. By submitting an Entry, the Participant explicitly allows FantaStory.com to contact the Participant via email, telephone, fax, postal mail and other means for marketing purpose regarding the Contest and/or FantaStory.com (unless the Participant chooses by contacting FantaStory.com at a  later date not to receive any marketing communications).  FantaStory.com values all personal information received and shall not transfer or disclose the Participant's personal information to any third parties (except when required by any law). 

Determination of Winners and Prizes

1. FantaStory.com shall be responsible for overseeing the Contest, including but not limited to overseeing all aspects of determining eligible submissions. By participating in the Contest, Participants agree to and shall comply with these Terms and Conditions and the decisions of FantaStory.com and the judges are final and binding in all respects.
2. FantaStory.com will post the Prize list along with details of Special Prize and Special Prize time periods on the website.  FantaStory.com may from time to time change and/or adjust the Prize list and other details of the Contest whose modifications will take effect at the time they are announced on the Contest website.
3. FantaStory.com may also from time to time specify Additional Prizes to be offered to Qualifiers, Semi Finalists, Finalists, Winners and other Participants.

Awarding of Prizes

1. FantaStory.com will publicly make available on it’s website, information about winners and their associated prizes.
2. Winners are required to contact FantaStory.com within 30 days of  public notification to claim their prize.
3. Members may or may not be required to provide to FantaStory.com proof of eligibility and copy of personal identification document; depending on the type of prize awarded.
4. Prizes cannot be exchanged for other prizes.
5. Prizes which are not presented or delivered for whatever reason shall remain the property of FantaStory.com.  If the prize is refused, it shall revert to FantaStory.com.
6. FantaStory.com retains the right to award an alternative prize of at least equal value if for whatever reason the aforementioned prize is not or no longer available or cannot be awarded.

Announcement of Winners

1. The screen name of the Winners will be announced and posted on the website.
2. By participating in the Contest, the Winner agrees that his/her name and submission may be published on the website.
3. If at FantaStory.com's request the Winners shall cooperate with FantaStory.com in the promotion of the Contest,. But the winners shall not be entitled to any remuneration. Any publication or other materials so published shall be the complete property of FantaStory.com.
4. FantaStory.com will handle Participants' data with care and respect the privacy of Participants.  Participants emails will not be posted on the website.

Miscellaneous

1. FantaStory.com may issue interpretive guidelines on its website or to prospective Participants regarding the provisions of these Terms and Conditions.  FantaStory.com may modify these Terms and Conditions from time to time, which modifications will take effect at the time they are announced on the website.
2. If any part of these Terms and Conditions is declared invalid or unenforceable for any reason, the remainder will be valid and enforceable as if the invalid or unenforceable part were not included herein. There shall be substituted for any invalid or unenforceable provision a suitable provision that, as far as is legally possible, comes nearest to the sense and purpose of these Terms and Conditions, taking into account all other applicable rules and policies.
3. FantaStory.com may in no case be held liable for any loss or damage caused by or in connection with: (a) the prizes, including, if applicable those provided by a third parties, and presented by FantaStory.com or (b) any events outside FantsStory's direct or indirect control. If for any reason there is any error, including a computer or human error, in relation to the award or distribution of the prizes, FantaStory.com shall not be liable and Participant shall have no actionable claim against or right to compensation from FantaStory.com.
4. Regardless of the cause or reason therefore, including, without limitation, unintentional human error by any person, no responsibility is assumed by FantaStory.com for lost, late, incomplete, misdirected, or illegible submissions; or for any computer, telephone, cable, satellite, network, electronic or Internet hardware or software malfunctions, failures, lost or unavailable connections, failed, delayed, garbled or jumbled transmissions, service provider/Internet/web site/use net accessibility or availability, traffic congestion, or unauthorized human intervention.
5. If for any reason the Contest is not capable of running as originally planned due to any reason, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures which in FantaStory.com's sole discretion corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, FantaStory.com reserves the right, at its sole discretion, to terminate, modify or suspend the Contest. In the event the Contest is so terminated, then these Terms and Conditions will be considered null and void and of no further force or effect and FantaStory.com will have no obligations or liability of any kind to any Participant. In the event the Contest is so suspended or modified, then FantaStory.com may determine, in its sole discretion, when and/or with what modification(s) the Contest will resume, and any subsequent Winner(s) will be determined in a manner which FantaStory.com determines, in its sole discretion, is fair, appropriate and consistent with these Terms and Conditions.
6. FantaStory.com is not responsible for any incorrect, inaccurate or incomplete information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest, and FantaStory.com assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the website, regardless of the cause or reason therefore. FantaStory.com is responsible for injury or damage to participants or to any other person's computer related to or resulting from participating in this Contest, from uploading or downloading materials to or from any website, or from use of any website.
7. IN NO EVENT WILL FantaStory.com AND THEIR RESPECTIVE OFFICERS. DIRECTORS, EMPLOYEES, MEMBERS, SHAREHOLDERS, ATTORNEYS, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES ARISING OUT OF ANY PARTICIPANTS' ACCESS TO AND USE OF ANY INTERNET SITES OR FROM UPLOADING OR DOWNLOADING TO/FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITE. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, FantaStory.com AND THEIR RESPECTIVE ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS. DIRECTORS, EMPLOYEES, MEMBERS, SHAREHOLDERS, ATTORNEYS, REPRESENTATIVES AND AGENTS MAKES NO WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE OR NON-INFRINGEMENT WITH RESPECT TO ANY WEBSITE UTILIZED TO ENTER THIS CONTEST. FOR THE AVOIDANCE OF DOUBT, NO PROVISION IN THESE TERMS AND CONDITIONS SHALL BE CONSTRUED AS LIMITING THE LIABILITY OF ANY PARTY FOR DEATH OR PERSONAL INJURY CAUSED BY SUCH PARTY'S NEGLIGENCE OR ANY LIABILITY WHICH CANNOT BE EXCLUDED UNDER GENERALLY APPLICABLE LAW.
8. By participating in this Contest, each Participant, releases, indemnifies and holds harmless FantaStory.com and their respective directors, officers, employees, members, shareholders, attorneys, representatives and agents, including advertising and promotion agencies, from and against any and all liability, judgments, claims, losses, damages, costs and expenses (including, without limitation, reasonable outside attorneys' fees) with respect to or in any way arising from participation in the Contest or the awarding, acceptance, possession or use (or misuse) of the Contest award, including, but not limited to, liability for personal injury.
9. If you do not agree to these terms, you should not participate in FantaStory.com.com contests and awards.
